Please read these terms and conditions carefully; nothing in them affects your statutory rights. By placing an order and accepting the quotation you signify your agreement to be bound by these terms.

General Disclaimer

Baines&Fricker will manufacturer to the specification of their customer, any necessary changes that need to be made due to any bespoke request Baines&Fricker will let their customer know Baines&Fricker will deal with the customer’s order in accordance with our obligations under the Sale of Goods Act1979 (as amended) and the Sale and Supply of Goods to Consumers Regulations 2002.

Payments

Contract Orders: Unless otherwise agreed, for your first Order a Pro-forma invoice will be issued, full payment will be required to confirm the order. After this, a 50% initial payment is required to confirm the order, the remaining 50% will be payable on delivery within 30 days.

Wholesale Orders: Unless otherwise agreed, for your first Order a Pro-forma invoice will be issued, full payment will be required to confirm the order. After this, a 50% initial payment is required to confirm the order, the remaining 50% will be payable on delivery within 30 days.

Private Orders: Unless otherwise agreed, individual private customers are to pay in full, unless otherwise agreed.

Payment is to be made via BACS to the account on the invoice.

Placing Orders

Contract and Wholesale Order: We require a Purchase Order on Letter Headed Paper, with full company details. Payment terms must be abided by.

Private: We require an order in writing, unless order through www.bainesandfricker.net Payment terms must be abided by.

Legal Jurisdiction

All our consumer contracts are governed by English law and shall fall under the exclusive jurisdiction of the courts of England. English is the official language offered for the conclusion of the contract. The statement of our terms and conditions of trade is in accordance with your statutory rights under the legislation above. Terms & conditions of purchase “Customer” means any person who is purchasing items from the Supplier. “Supplier” means Baines&Fricker Ltd.

Title

Title in the Goods shall not pass until the price of the outfit(s) and payment has been agreed as per the payment terms below.

Supplier’s Obligations

The supplier warrants that the products description will correspond with the description logged by the customer at the time of purchase. The supplier shall ensure that all products supplied to the Customer are capable of being altered. There will be an additional expense in making alterations to the products specified. The Supplier shall not be liable for the any loss or cancellation of order relating to a change in the specification, for example dimensions or aesthetic change of the customer after the order was placed.

Customer’s Obligations

To enable the Supplier to perform the contractual terms and produce a high quality product, the customer must co-operate with the supplier by providing the supplier with their exact measurements/ dimensions if the product is bespoke, along with any aesthetic considerations. The Supplier shall not be liable for the any loss or cancellation of order relating to a change in the specification, for example dimensions or aesthetic change of the customer after the order was placed.
